How to legally sublet your apartment in Belgrade

Subletting can help a tenant manage an extended absence, reduce housing costs, or accommodate a temporary change in work or study. In Belgrade, however, a sublease is not simply an informal arrangement between the current tenant and a new occupant. It creates legal responsibilities for several people, including the apartment owner, the original tenant, and the subtenant.

The safest approach is to review the existing lease, obtain the landlord’s written approval, and prepare a separate written sublease agreement. Clear documentation can prevent disputes over rent, utilities, damage, notice periods, and the right to remain in the property.

Serbian housing and contract rules can be affected by the wording of the original agreement and the specific circumstances of the occupancy. General information is useful for preparation, but a legal professional should review unusual arrangements, significant deposits, business use, or disagreements with the landlord.

Check whether subletting is permitted

Begin with the lease you signed with the property owner. Look for clauses using terms such as sublease, assignment, additional occupants, consent, or use of the premises. Some agreements prohibit subletting completely, while others allow it only with prior written consent. A clause allowing guests to stay does not necessarily authorize a separate rental arrangement.

Even where the lease is silent, obtaining written permission is the prudent course. Send the landlord a short request identifying the proposed subtenant, the expected dates, and whether the whole apartment or only one room will be sublet. Keep the response with the original lease. A verbal approval may be difficult to prove if the relationship later deteriorates.

The original tenant normally remains responsible to the owner under the primary lease. If the subtenant stops paying, damages the apartment, violates building rules, or uses the premises unlawfully, the owner may still pursue the original tenant. Subletting therefore transfers possession for a period; it does not automatically transfer the original tenant’s obligations.

Prepare a written sublease agreement

A written agreement should identify the parties with their full names, identification details, addresses, and contact information. It should describe the apartment precisely, including the address, floor, room being rented, shared areas, furniture, appliances, parking space, and any storage area. If the subtenant is renting only a room, the contract should state which kitchen, bathroom, and other facilities may be used.

State the beginning and ending dates, monthly rent, payment date, payment method, deposit, utilities, internet charges, and other expenses. Explain how utility bills will be calculated when they are shared. The agreement should also say whether rent may be changed, whether renewal is possible, and how either party must give notice.

Attach an inventory and photographs taken when the subtenant moves in. Record existing stains, damaged furniture, meter readings, keys, and the general condition of the property. Both parties should sign the inventory. This evidence is especially valuable when deciding whether a deposit can be withheld at the end of the arrangement.

Write the agreement in Serbian or provide a reliable Serbian version alongside any English text. If the subtenant does not understand Serbian well, both versions should be reviewed carefully so that rent, notice, and liability provisions have the same meaning.

Set fair financial and registration terms

The sublease should make clear whether the rent includes building maintenance, electricity, water, heating, internet, cleaning, and other charges. In Belgrade, heating arrangements and utility billing can vary by building, so avoid vague wording such as “bills included” unless the parties specify what that covers and how unusually high consumption will be handled.

Use traceable payments, such as a bank transfer, and retain receipts for cash payments. The agreement should explain the deadline for returning the deposit, permitted deductions, and the procedure for notifying the subtenant about alleged damage. A deposit should not be treated as the final month’s rent unless the contract expressly allows that arrangement.

Rental income can create tax obligations for the person receiving it. The tax position may depend on whether the payment is received by the apartment owner or the principal tenant, the parties’ status, and the nature and duration of the arrangement. Before accepting regular sublease income, obtain current guidance from the Serbian Tax Administration or a qualified accountant. A private contract does not remove public-law obligations.

A subtenant may also need proof of address for administrative, employment, banking, or immigration purposes. Registration rules differ depending on whether the occupant is a Serbian citizen or a foreign national and whether the stay is temporary or permanent. The parties should agree in writing who will provide documents and cooperate with any required registration rather than promising a procedure they have not verified.

Issue What the agreement should clarify Useful evidence
Permission Whether the owner approved the sublease and for which dates Signed consent or written message
Payments Rent, due date, deposit, utilities, and payment method Bank records and receipts
Condition Furniture, appliances, meter readings, and existing damage Signed inventory and photographs
Occupancy Named residents, guests, pets, smoking, and business use Copies of identification and house rules
Ending the arrangement Notice period, early termination, handover, and deposit return Written notices and a signed move-out record

Protect privacy, safety, and building rules

The sublease should name every person who will live in the apartment. Do not assume that a tenant may move in friends, partners, or short-term guests without restriction. Set reasonable rules for overnight guests, noise, smoking, pets, parties, and use of shared spaces. The apartment’s building rules apply to occupants even when they are not parties to the primary lease.

Collect only the personal information needed for the arrangement and store copies of documents securely. Identification documents should not be circulated in building group chats or shared with unrelated people. If a landlord or principal tenant needs documents for registration or legal compliance, the purpose and handling of those documents should be clear.

Safety concerns should be addressed without discriminatory screening. A landlord or tenant should not reject someone because of a protected personal characteristic. Instead, use objective criteria such as proof of identity, ability to pay, references where appropriate, and agreement to the property rules.

If harassment, threats, coercive control, or violence arises, treat it as a safety and legal issue rather than merely a rental dispute. NOMCENTAR’s explanation of Serbia’s domestic violence law can help readers understand available protections and why urgent circumstances may require contacting the police or specialized support services.

Manage termination and disputes lawfully

The agreement should explain how notice must be delivered and when it becomes effective. Email, registered mail, or another recorded method can create useful proof. If the sublease has a fixed end date, state whether it ends automatically or whether additional notice is required. Align the sublease period with the original lease and the landlord’s written permission.

A tenant should not change the locks, remove belongings, disconnect utilities, or use threats to force someone out. If the subtenant refuses to leave, the appropriate remedy may depend on the agreement and the facts. Written demands, negotiation, mediation, or court proceedings may be necessary. Self-help measures can increase liability and complicate recovery of possession.

At move-out, inspect the apartment with both parties present when possible. Compare its condition with the inventory, record meter readings, collect keys, and document any damage. Provide a written calculation for legitimate deductions from the deposit and return the balance within the period stated in the agreement.

Early legal advice is particularly valuable when rent is unpaid, the owner denies permission after the subtenant has moved in, several people share the property, or the apartment is being used for short-term tourist accommodation. A written record of communications, payments, and property condition will make that advice more effective.

Use available legal support

NOMCENTAR NGO works to make legal knowledge and access to justice more accessible in Serbia. Its work and mission provide useful context for people who need understandable information about civic and legal issues, including housing-related concerns.

People who cannot easily afford professional advice may be able to seek free legal aid. Eligibility and the scope of assistance can depend on the applicant’s circumstances and the matter involved, so provide the relevant lease, proposed sublease, landlord communications, payment records, and any notices received.

Before signing, use this practical checklist:

A carefully drafted sublease protects the owner, the original tenant, and the incoming occupant. Review the documents before anyone moves in, address uncertainties in writing, and seek qualified assistance promptly when consent, safety, tax, or possession issues are unclear.
